1. INTERPRETATION:
In these Competition Rules, the following definitions apply (unless the context clearly indicates a contrary intention):
- “the Act” means the Consumer Protection Act, No. 68 of 2008 (South Africa);
- “Competition Rules” means the rules, terms, and conditions set out herein, as required by section 36 of the Act;
- “Participant" means an individual who enters the Promotion and meets the criteria contemplated in clause 4;
- “POPI” means the Protection of Personal Information Act, No. 4 of 2013 (South Africa); - “Promoters” means Banhoek Chilli Oil, and “Promoter” shall refer to either one of them as the context requires;
- “Promotion” means the Banhoek Chilli Oil & Gozney Father’s Day Promotion to which these Competition Rules apply;
- "Promotion Period” means the period from 26 May 2025 until 22 June 2025, or such other date as determined by the Promoters;
- “Prize” means the prizes described in clause 6;
- “Winner” means a Participant who is successful in the Promotion and is notified as such by the Promoters in accordance with clause 7.**
2. INTRODUCTION:
The Promoters are offering this Promotion, in which Participants can enter to win prizes, subject to these Competition Rules.
3. THE CONSUMER PROTECTION ACT REQUIRED NOTICE:
These Competition Rules contain terms that may:
- limit the risk or liability of the Promoters or third parties;
- create risk or liability for Participants;
- require Participants to indemnify the Promoters or third parties;
- serve as an acknowledgment that Participants understand and agree to these Rules.
4. THE PARTICIPANT:
Participants must:
- be a natural person, holding a valid South African identity document or passport;
- be 18 years or older;
- be a South African citizen or resident, residing in South Africa for the duration of the Promotion Period;
- not be an employee, director, agent, or consultant of the Promoters, nor be an immediate family member of such persons;
- participate entirely at their own risk and have had the opportunity to read and understand these Rules.
5. ENTRY MECHANICS:
Participants can enter by:
- purchasing a bottle of Banhoek Chilli Oil from a participating South African store during the Promotion Period;
- uploading their details via the entry portal at https://banhoekchillioil.com/pages/promotions before 23:59 on 22 June 2025 & retain their proof of purchase for the prize draw;
- participating as many times as they like, provided each entry is accompanied by a valid purchase.
6. THE PRIZES:
- Main Prize: a Gozney Portable Pizza Oven, a year’s supply of Banhoek Chilli Oil and a branded chopping board valued at R17 000.
- Secondary Prize: a Gozney Pizza Cutter, a half-year’s supply of Banhoek Chilli Oil, and a branded apron valued at R2 500.
Prizes are non-transferable, non-exchangeable, and no cash alternatives will be offered. The Promoters reserve the right to substitute prizes of equal or greater value.
7. PROMOTIONAL DRAW:
- The draw will take place after the Promotion ends, on or before 5 July 2025, and will be conducted by an independent auditor.
- Winners will be notified via email and/or phone within 7 days of the draw.
- Winners will have 14 days to respond and claim their prizes. If unclaimed, a reserve winner may be selected.
8. PRIZE QUALIFICATION RULES:
- Prizes will only be awarded if legal to do so in South Africa.
- Winners must provide proof of identity and residency, and sign any necessary documentation to claim their prizes.
- The Promoters reserve the right to verify all entries and disqualify any Participant who breaches these Rules or attempts to manipulate the Promotion.
9. THE RULES:
- Participants must be South African residents, aged 18 or over, with valid identification.
- Employees, directors, agents, or immediate family members of the Promoters or associated companies are not eligible.
- The Promotion runs from 26 May 2025 to 22 June 2025.
- Entries received after the closing date will be invalid.
- Entries must be submitted via the designated online portal.
10. GENERAL:
- By participating, Participants agree to be bound by these Rules and the decisions of the Promoters, which are final.
- The Promoters reserve the right to cancel, modify, or suspend the Promotion at any time without notice.
- The Promoters may require Winners to participate in publicity and promotional activities without compensation.
- Personal data collected will be used solely for the purposes of this Promotion in accordance with the POPI Act and the Promoters’ Privacy Policy.
- The Promotion is not sponsored, endorsed, or administered by Facebook, Instagram, or other social media platforms.
11. GOVERNING LAW:
This Promotion is governed by South African law, and disputes will be subject to the exclusive jurisdiction of South African courts.
